A patent protection of your product seems possible. Recommandations :

  • protect your product with a patent in order to have a legal protection against copying competitors, but also in order to improve the situation with investors and for getting tax reductions in the future.
  • discuss at an early stage with a trademark attorney the chosen name Streetbrewers and the name for the microbrewery so that you can obtain a strong protection for your brands.
  • get regularly a copy of the software code of your software from the developing supplier and to register them (i-depot or other registering service) to have proofs of the date of the different software versions, if you have no direct access to the version control system of your developer.
  • regulate in the contract with the developing supplier that all IP related to this software belongs to the company.
  • identify all trade secrets of the project/company and establish measures to protect them.

The number of patents filed in your field is rather low and the general danger is probably lower than in other fields. Nevertheless, we noted that the patent filings in the field of microbreweries went up recently. Also for this reason, own patents could help in case of conflict to negotiate a deal.

  • go through the list of patent families identified (in particular the claims) to see, if there is a potential problematic patent for you.
  • go through your open source modules and their licenses used, to see if there is a copyleft open source license.
  • establish guidelines for the use of open source licenses.
